Terms and Conditions for offers from Dengler Hof

Dear Guest,

We are delighted to welcome you to our glamping farm and wish you a pleasant stay!

The following terms and conditions apply to all contracts between Dengler Hof, owner Martin Dengler (hereinafter “Dengler Hof”) and you as a guest (hereinafter “Guest”) for accommodation services through the rental of accommodation (Part A.), for riding activities (Part B.) and canoe rental (Part C.).

A. Accommodation

§ 1 Subject Matter of the Contract and Conclusion of the Contract

  1. The subject matter of the contract is the rental of accommodation, as well as all other services provided to the guest by the Dengler Hof.
  2. Booking inquiries from the guest are made either via the website or by contacting us via email. The booking inquiry by the guest already constitutes a binding offer to conclude a contract.
  3. The contract is concluded upon receipt of the declaration of acceptance by the Dengler Hof.

§ 2 Obligations

  1. The Dengler Hof is obliged to provide the accommodation booked by the guest and to provide the agreed services.
  2. The guest is obliged to accept the contractual service and to pay the agreed fee for the use of the accommodation and the services used by him. This also applies if the guest arranges services and expenses to third parties.
  3. The subletting or re-letting of the provided accommodation is generally not permitted. The only exception to this is if the Dengler Hof has agreed to the subletting or re-letting in writing.
  4. The use of the accommodation is limited to the number of people specified by the Dengler Hof. Use with a number of people exceeding this number is prohibited.
  5. The guest is obliged to inform the host immediately and without being asked if the intended purpose of the stay – be it due to its political, religious or other character – is likely to arouse public interest or impair the interests of the host.

§ 3 Payment Methods and Deposit

  1. As soon as the Dengler Hof confirms the booking request, the guest must pay a 30% deposit of the agreed price within seven days.
  2. If special conditions are agreed, the guest must make full payment within seven days.
  3. Any remaining amount must be paid no later than seven days before arrival.
  4. The agreed prices include the taxes and local charges applicable at the time the contract is concluded. Local taxes that are owed by the guest himself under applicable municipal law are excluded from this and must be paid by the guest and fellow travelers on site.
  5. An offsetting against the Dengler Hof is only possible with an undisputed or legally established claim.
  6. Payments are made by bank transfer or by other payment methods accepted by the Dengler Hof.

§ 4 Provision of Accommodation

  1. Check-in is possible from 4 p.m. to 6 p.m. on the day of arrival. If checking in later, the guest must inform the Dengler Hof.
  2. If check-in takes place without prior arrangement after 8 p.m., a flat fee of €30 may be charged for the costs incurred. The guest is free to prove that no costs were incurred or that the costs incurred by the Dengler Hof are lower than the flat fee charged.
  3. Check-out on the day of departure must take place by 10 a.m. at the latest.
  4. If check-out takes place after 10 a.m. on the day of departure, the Dengler Hof can charge 50% of the list price as compensation for the use exceeding the contract until 6 p.m., and 100% from 6 p.m. The guest is free to prove that the Dengler Hof is not entitled to a usage fee or that the usage fee is lower than the flat fee charged.

§ 5 Cancellation by the Guest

  1. Cancellation of the contract concluded with the Dengler Hof is possible if the guest has a statutory right of withdrawal. In all other cases, cancellation requires the consent of the Dengler Hof in writing.
  2. In any case, the cancellation must be made in writing.
  3. If there is no statutory right of withdrawal and the Dengler Hof does not give its consent in writing, the guest must pay the agreed accommodation fee even if he does not make use of the contractually agreed service. However, the expenses saved and the income from renting the accommodation elsewhere must be taken into account.
  4. If the guest cancels the booking or does not arrive on time on the day of arrival, the Dengler Hof is entitled to rent the accommodation elsewhere.
  5. If the accommodation is not rented elsewhere and there is no statutory right of withdrawal or consent from the Dengler Hof, the Dengler Hof is free to demand a cancellation fee of 90% of the agreed price instead of the specifically calculated compensation according to paragraph 3. The guest is free to prove that no damage was incurred or that the damage incurred by the Dengler Hof is lower than the flat fee charged.
  6. If the accommodation is rented elsewhere and there is no statutory right of withdrawal or consent from the Dengler Hof, the Dengler Hof is free to demand a cancellation fee of 10% of the agreed price instead of the specifically calculated compensation according to paragraph 3. The guest is free to prove that no damage was incurred or that the damage incurred by the Dengler Hof is lower than the flat fee charged.
  7. If the cancellation is made without a statutory right of withdrawal or consent from the Dengler Hof more than 12 weeks before the day of arrival, the Dengler Hof is not entitled to demand the accommodation fee according to paragraph 3 or the flat fees mentioned in paragraphs 5 and 6. Instead, the Dengler Hof has a flat-rate claim to 3% of the agreed accommodation fee. The guest is free to prove that no damage was incurred or that the damage incurred by the Dengler Hof is lower than the flat fee charged.
  8. The guest will receive the invoice for the cancellation after the end of his booked stay. He has to pay this within eight days.
  9. It is recommended to take out travel cancellation insurance.

§ 6 Withdrawal by the Dengler Hof

  1. The Dengler Hof is entitled to withdraw from the contract if there is an objectively justified reason.
  2. An objectively justified reason exists in particular if
  3. the deposit is not paid within the specified period of seven days,
  4. an agreed, due service of the guest is not provided even after setting a reasonable grace period,
  5. the guest sublets or re-lets the accommodation without the consent of the Dengler Hof in writing,
  6. force majeure, such as natural disasters, strikes or political unrest, or other circumstances for which the Dengler Hof is not responsible make the fulfillment of the contract impossible,
  7. the host has a justified reason to believe that the use of the services by the guest may endanger the smooth running of the business, the safety or the reputation of the host in public, or
  8. the guest provides misleading or false information about his person or other essential facts.
  9. In the event of withdrawal by the Dengler Hof in accordance with this provision, the guest shall not be entitled to any claims for damages.

§ 7 Warranty, Limitation

  1. If the guest has received a service and defects or malfunctions occur, he must notify the Dengler Hof immediately.
  2. The Dengler Hof will work to remedy the situation as soon as it becomes aware of it or upon complaint from the guest.
  3. The guest’s claims against the Dengler Hof become statute-barred one year after the start of the statutory limitation period. This does not apply to claims for damages based on injury to life, limb or health, or to claims for damages based on an intentional or grossly negligent breach of duty by the Dengler Hof or on an intentional or negligent breach of contractual obligations typical of the Dengler Hof. The breach of duty by the Dengler Hof is equivalent to a breach of duty by employees or a legal representative.
  4. The limitation period begins at the end of the year in which the claim arose and the guest becomes aware of the circumstances giving rise to the claim and the person of the debtor or should have become aware of them without gross negligence.

§ 8 Liability

  1. The liability of the Dengler Hof is governed by the statutory provisions. In particular, §§ 701 ff BGB apply to items brought in by the guest.
  2. The Dengler Hof and its vicarious agents are only liable for intent and gross negligence. This limitation does not apply to damages resulting from the breach of essential contractual obligations and to damages resulting from injury to life, limb, or health, which are based on an intentional or negligent breach of duty by the Dengler Hof and its employees and vicarious agents.

§ 9 House Rules and Pets

  1. The guest must respect the peace and privacy of the other guests.
  2. Noise and disruptive behavior are not permitted, especially between 9:00 p.m. and 8:00 a.m. After the evening animal feeding is complete, the stable may no longer be entered (stable rest).
  3. Holding celebrations, especially with more than the number of people permitted for the accommodation, is not permitted.
  4. Entering paddocks, stables and horse boxes without the permission or accompaniment of an employee of the Dengler Hof is not permitted.
  5. Pets are allowed in some accommodations for a pet fee. The guest must inform the Dengler Hof in advance whether he is bringing pets.
  6. The pet fee is €7 per night for dogs up to 50 cm shoulder height and €10 per night for dogs over 50 cm shoulder height.
  7. Dogs must always be kept on a leash in the area of the paddock and stables.
  8. Smoking is prohibited in the accommodations.

§ 10 Security:

  1. The guest must strictly follow safety instructions and warnings issued by the Dengler Hof and its staff.
  2. The accommodations are located within an agricultural farm, which is associated with an increased risk of accidents. Stables and agricultural equipment and facilities are not a playground. The guest should therefore behave appropriately to the risk. In particular for holidays with children, it is pointed out that parents are liable for violations of their duty of supervision in accordance with the statutory provisions.
  3. According to the fire protection regulations and to protect guests and facilities, fire is only permitted in the designated fireplaces. In order to avoid overheating of the fireplaces and sparks flying out of the chimney, the fireplaces may only be operated with closed doors.

§ 11 Final Provisions

The law of the Federal Republic of Germany applies exclusively to all legal relationships between the guest and the Dengler Hof, excluding the UN Convention on Contracts for the International Sale of Goods. This only applies to consumers insofar as this does not undermine mandatory legal provisions of the state in which the consumer has his habitual residence.

B. Riding Activities

§ 1 Subject Matter of the Contract

  1. For a fee, the Dengler Hof enables the use of ponies and horses by prior arrangement. The offer is subject to availability, weather conditions and prior arrangement.
  2. The respective period of use will be agreed with the Dengler Hof and must not be exceeded.
  3. Payment is made in cash at the latest at the end of the stay before departure.
  4. The employees of the Dengler Hof select the horses that are suitable for the riders at their own discretion.

§ 2 Code of Conduct for Riders

  1. Pony and horse riding involves inherent risks, especially because ponies and horses can show unpredictable behavior at any time. Guests must therefore follow the instructions of the staff at all times and without fail and behave appropriately in these circumstances. Violation may lead to immediate termination of the contract without refund.
  2. Wearing an approved safety helmet is mandatory for all riders, regardless of age or experience. Wearing a back protector or protective vest is recommended.
  3. Wearing suitable footwear when riding is mandatory (shoes with heels, no sneakers or low shoes).
  4. Mistreatment or cruel behavior towards the animals will not be tolerated and may lead to immediate termination of the contract without refund.

§ 2 Special Requirements for the Rider

  1. Riders must meet the minimum age and weight requirements set by us. These can be requested from us.
  2. If there is no experience with riding ponies or horses, the Dengler Hof offers the necessary instruction and supervision by arrangement and subject to availability.
  3. Riders must report relevant medical conditions or allergies to the staff of the Dengler Hof before riding.
  4. Pregnant women are strongly advised against participating in pony or horse riding activities.
  5. The Dengler Hof reserves the right to refuse participation in pony or horse riding at its own discretion if there are indications of an increased risk for riders and animals.

§ 3 Cancellations by the Guest

  1. Cancellations of agreements for pony or horse riding by the guest must be reported at least one day in advance.
  2. In the event of cancellations at shorter notice, the Dengler Hof may demand reimbursement of costs incurred upon proof (e.g. due to futile travel by staff).

§ 4 Cancellation by the Dengler Hof

The Dengler Hof reserves the right to cancel pony and horse riding if the respective animal behaves inappropriately, safety problems occur or riding is exceptionally not feasible for other reasons, such as due to weather and weather conditions. If the fee has already been paid, there is a claim for reimbursement.

§ 5 Liability

  1. Riding is always at your own risk.
  2. The Dengler Hof and its vicarious agents are generally only liable for intent and gross negligence. In particular, liability under § 833 BGB is excluded.
  3. This limitation of liability does not apply to damages resulting from the breach of essential contractual obligations and to damages resulting from injury to life, limb or health based on an intentional or negligent breach of duty by the Dengler Hof and its employees and vicarious agents.

C. Canoe Rental

§ 1 Subject Matter of the Contract

  1. For a rental fee, the Dengler Hof provides the guest with a canoe for independent use.
  2. The possibility of use exists only by arrangement within the scope of availability and as far as the weather conditions permit. The instructions of the Dengler Hof regarding the place of use and behavior in nature must be followed.
  3. Payment is made in cash at the latest at the end of the stay before departure.
  4. The transport of the canoe to and from the Dengler Hof and the place of use is organized by the Dengler Hof by arrangement. The rental price includes the necessary equipment such as boat, paddles, life jackets and waterproof packsacks as well as transport to and from the location.

§ 2 Contract Duration

The rental period is one day each.

§ 3 Code of Conduct for Tenants

  1. The tenant must treat the canoe with care and consideration.
  2. The tenant alone is entitled to steer the canoe. The canoe may neither be steered by other persons nor may it be sublet.
  3. The tenant must report defects on the canoe or the equipment to the landlord immediately.
  4. The tenant is liable for damage to the canoe or the equipment that is due to improper use. The damage must be reported to the Dengler Hof immediately.

§ 4 Cancellation / Withdrawal

  1. Neither weather nor personal circumstances such as illness entitle the tenant to withdraw from the rental agreement.
  2. The rental fee must also be paid in these cases. However, the Dengler Hof must have saved expenses and those benefits credited that he obtains from other use.

§ 5 Liability

The Dengler Hof and its vicarious agents are only liable for intent and gross negligence. This limitation does not apply to damages resulting from the breach of essential contractual obligations and to damages resulting from injury to life, limb, or health, which are based on an intentional or negligent breach of duty by the Dengler Hof and its employees and vicarious agents.
